Investigation by the Possible Commission of Relative Monopolistic Practices on the Liquefied Petroleum Gas Industry.

On March 5th, 2019, was published in the Federal Official Gazette the notice by means of which the investigating authority of the Federal Economic Competition Commission (COFECE by its acronym in Spanish) reports the initiation of an investigation by the possible commission of relative monopolistic practices in relation to the importation, commercialization, transport, storage, distribution and sale of liquefied petroleum gas industry in Mexican territory.

Said notice refers to the initiation of an investigation procedure consequence of a complaint; at the moment there has not been identified any specific acts, agreements or activities that imply certain control on the liquefied petroleum gas market or another conduct that could constitute a relative monopolistic practice against the Federal Economic Competition Law and it has not been pointed out the presumed responsible party.

In such terms, the General Markets Investigating Authority could request information and documentation, perform verification visits or some citations to declare those parties that have some relation with the investigation, in order to obtain supportive evidence.

In this sense, in addition to the faculties that are exercised with respect to the investigated entities, suppliers or customers of the liquefied petroleum gas industry, could receive an information requirement from COFECE in order to provide information and documents as a coadjutant party.
