Impact of the Amendment Labor Law ("Outsourcing") on Immigration Matters

Subcontracting compliance - extension of terms

Derived from the amendment of several laws to regulate labor subcontracting and the agreement that establishes general provisions by which natural or legal persons that provide specialized services or carry out specialized works must be governed, such as their registration before the Registry of Providers of Specialized Services or Specialized Works (REPSE, by its acronym in Spanish) of the Ministry of Labor and Social Welfare.

 The National Immigration Institute (INM, by its acronym in Spanish), recognizes the amendment and in order not to dispute with it, natural and legal persons, will have the following obligations before the INM: 

In the process of Obtaining the Employers Certificate and its corresponding Update (the "Certificate"), the Notice of Registration must be submitted as providers of specialized services or execution of specialized works issued by the REPSE.

 The Certificate must be updated every 3 years, derived from renewing the Registration Notice before the REPSE. 

In addition, it must be updated when it is in the assumptions provided in the immigration regulation. 

If the INM detects a violation of the amendment to the labor subcontracting, the certificate will be canceled, and the corresponding authorities will be informed so that they act in accordance with the appropriate law.
