The Ministry of Labor and Social Welfare has launched the Complaints and Workplace Accidents System (SIQAL), a digital platform that is now operational and represents a significant advancement in the protection of labor rights in Mexico.
Through SIQAL, employees may file:
- Complaints: When employees labor rights are violated or their integrity is put at risk, such as in cases of non-affiliation with the Mexican Social Security Institute (IMSS), non-payment of overtime, workplace harassment, lack of training, or the provision of specialized services without REPSE registration.
- Accidents: Reports of accidents that have occurred in the workplace, regardless of whether the incident happened to the employee filing the report or to a third party. As well as to report unsafe working conditions that put the physical integrity of employees at risk.
- Breach of individual/collective contracts: To be used when the agreed-upon labor conditions established in an individual or collective contract are not honored, such as: reduction of vacation days, Christmas Bonus, incentives, etc.
The implementation of SIQAL is directly linked to the STPS Digital Inspection System (SIDIL), a technological tool that enables the labor authority to plan, conduct, and monitor inspections in a more strategic manner, which makes it possible to identify workplaces with a higher risk of non-compliance and optimize inspections, streamlining the handling of complaints.
This new approach means that companies must be prepared to face increased oversight, as these complaints could trigger immediate inspections. Therefore, at Cuesta Campos, we recommend:
- Verify compliance with current legal provisions through regular internal audits.
- Provide employee training to keep staff updated on new labor regulations.
- Document internal protocols related to safety, hygiene, and accident prevention.
- Implement an internal complaints channel, which is essential for addressing labor issues internally and preventing formal complaints from being filed before the authorities.
The purpose of these measures is to ensure quality, prevent penalties during inspections, and guarantee both employer compliance and the protection of labor rights.
