We would like to inform you that on April 8, 2026, the Joint Committees on Labor and Social Welfare, and Legislative Studies of the Mexican Senate, approved the decree amending the Federal Labor Law (LFT) regarding working hours. This legislative progress is critical for the operational planning of workplaces in Mexico.
Key Points of the Reform:
- Workweek Reduction: Article 59 of the LFT is amended to establish that the maximum duration of the ordinary workweek shall be forty hours.
- Weekly Rest Remains Unchanged (Art. 69): It is crucial to clarify that the right to at least one day of rest with full pay for every six days of work remains in place. The reform does not mandate two rest days but reduces the total limit of hours worked.
- Distribution Flexibility: Article 58 now allows the workweek to be distributed by mutual agreementbetween the employer and the employee. This enables 5-day work / 2-day rest schedules once the 40-hour limit is reached, depending on the company’s operational needs.
- Gradual Implementation (2027-2030): The reduction will not be immediate. The transitory provisions establish the following timeline to reach the 40-hour goal:
- 2027: 46 hours per week.
- 2028: 44 hours per week.
- 2029: 42 hours per week.
- 2030: 40 hours per week.
- Wage Protection: The reform explicitly prohibits any reduction in wages or benefits resulting from the decrease in working hours.
- Electronic Record: The Employer shall be required to maintain a record including the start and end times of the workday, noting that non-compliance may result in fines ranging from 250 to 5,000 UMAs.
