Investigation by the possible commission of absolute monopolistic practices in relation to the maize flour in Mexican territory.

On April 9th, 2019, it was published in the Federal Official Gazette the notice by means of which the investigating authority of the Federal Economic Competition Commission (COFECE by its acronym in Spanish) reports the initiation of an investigation by the possible the realization of absolute monopolistic practices in relation to the production, distribution and commercialization of maize flour in Mexican territory.

Said notice refers to the initiation of an investigation procedure derived from the existence of public information to which COFECE had access regarding facts that derive on the possible realization of absolute monopolistic practices in the market of production, distribution and commercialization of maize flour.

The objective of this investigation is to determine if the conducts prohibited by law have been performed or are being performed, at the moment there has not been any identified specific acts or activities that imply an absolute monopolistic practice that violates the Federal Law of Economic Competition (LFCE by its acronym in Spanish ) and it has not been pointed out to the presumed responsible party.

In such terms, the General Absolute Monopolistic Practices Authority, could request information and documentation, perform verification visits or deliver citations to declare those parties that have some relation with the investigation, in order to obtain supportive evidence.

It is important to mention that the investigation period will not be of less than thirty days nor longer than one hundred and twenty days, counted from the day that the abovementioned notice was published, and it could be extended up to four times.

Therefore, there is a possibility that companies that have any relationship with the maize flour industry, either as a consumer, producer or distributor, could receive an information requirement COFECE.
