Amendments to the general foreign trade rules for 2018 and its exhibits.

On September 20th, 2018, several amendments (the “Amendments”) to the General Foreign Trade Rules for 2018 and its Exhibits (the “Rules”) were published in the Federal Official Gazette (DOF for its acronym in Spanish).

The following are the most relevant items of the Amendments:

  • In regards to courier companies and general warehouses that have authorization to render electronic pre-validation services, the term for the compliance of obligations to protect personal data and security measures of the General Customs Administration, was extended to December 31st, 2018.
  • Also, scenarios whereby stating an erroneous name, corporate name or address in the customs declaration, or in the electronic transmission, will not constitute false or non-existent data.
  • Likewise, guidelines for the warranties for the payment of taxes for temporary importation of materials included in Annex II of the IMMEX Decree were created.
  • Finally, certain additional requirements that must be met by any person or entity interested in obtaining the modality of Certification of Value Added Tax (“IVA”) and Production and Services Special Tax (“IEPS”).

The Amendments seek to reduce the use of paper in the clearance of merchandise, and thus, the customs declarations and other information must be submitted electronically.
