of the Area and Services


Our antitrust team works jointly with our energy, telecom and regulated markets practice to support on antitrust assessment topics, advice on bidding participation and regulatory compliance, as well as the implementation of internal policies.

We have broad experience in the representation of multinational and domestic corporations in the antitrust assessment of mergers, acquisitions, joint ventures and other types of collaborations pursuant to Mexican antitrust regulation.

Our services include:

Antitrust filings for the clearance of transactions subject to pre-merger approval from the Mexican Economic Competition Commission (“COFECE”) under applicable law.

Legal advice on antitrust compliance, including the design and implementation of policies, guidelines and training sessions under compliance programs.

Analysis of contracts and legal guidance to avoid the infringement of applicable law with respect to cartels, abuse of dominance and other forbidden practices based on regulations, criteria and case law experience in Mexico.

Collaboration with foreign law firms in the antitrust assessment of M&A transactions and contracts with international scope.

Support in the preparation of information or consultation for inquiries made by the antitrust authority during investigations, and evaluation of circumstances to determine the feasibility of filing antitrust complaints for the initiation of investigations.

Legal representation and advice on a purchase transaction for a world leading electronics manufacturer. Our firm assisted and advised them on antitrust matters, including the preparation and filing of the respective antitrust filing, with all the information required by the Mexican Economic Competition Commission, in connection with an asset purchase agreement executed between our client and a leading mobile and technology company, in which assets with an approximate value of US$71 million were transferred to our client (part of the assets were located in Mexico).

Legal representation and advice for a leading company in the automotive sector focused on the engineering, design and manufacturing of products for major car companies. Cuesta Campos supported on the implementation of internal policies to handle the commercial relationship with competitors and distributors, drafting the documentation required to comply with antitrust applicable legal provisions, and at the same time ensuring brand protection in the market.

Legal advice to a leading manufacturer of apparel and footwear in the analysis of certain sale strategies and initiatives regarding antitrust compliance on potential vertical restrictions and policies with distributors and business partners.

Legal advice to clients on different industries and business operations in the design and implementation of antitrust policies, including training. It also involved antitrust compliance pertaining to the relationship and communications with competitors, distributors and suppliers.
